Patricia Peden
Patricia Peden is a partner at Warren Kash Warren.
Patricia has over two decades of experience serving as lead counsel in intellectual property and other complex commercial disputes in federal and state courts in Texas and across the country. Patricia’s practice spans a wide range of technology areas and subject matter, including representing clients in patent, copyright, trade secret, contract and anti-SLAPP litigation, as well as federal appeals.
Patricia focuses on the factual, legal, and economic details that matter, never losing sight of the client’s business objectives. She has served as lead counsel for defendants in large-scale patent infringement actions arising from extensive infringement campaigns, consistently achieving early favorable outcomes for her clients using a “rifle shot” method of quickly identifying case-dispositive issues.
Patricia brings substantial experience in early case planning and project management, ensuring efficient representation in every case. She strives to provide clients with concrete solutions to complex legal problems.
When she is not busy with client work, Patricia can be found skiing—badly but enthusiastically—bingeing podcasts, and scouring antique shows and thrift shops for “just one more” quirky find.
Notable Representations
Nextpulse LLC v. Brunswick Corporation. Lead counsel for Brunswick Corporation defending against claims of trade secret misappropriation, breach of contract, and fraud claims. Patricia achieved a substantial reduction in the plaintiff’s claimed damages through an early dispositive motion win. She later won additional crucial dispositive motions, notably the dismissal of the plaintiff’s trade secret claim via summary judgment. Patricia successfully argued a spoliation motion, leading to an adverse inference jury instruction and a highly favorable settlement.
Balsam Brands Inc. v. Cinmar, LLC and UCP v. Balsam Brands. Lead counsel for UCP in a patent infringement lawsuit and related actions. Patricia successfully defended against the plaintiff’s motion for restraining order, and prevailed on a motion for summary adjudication, leading to a prompt and favorable settlement.
Abiomed Europe GmbH. Lead counsel for AIS GmbH Aachen Innovative Solutions Abiomed Europe GmbH in proceedings to enforce an application under 28 U.S.C. § 1782 for use in patent litigation in Germany. After securing a victory at the trial court, Patricia successfully defended Abiomed’s victory in writs and appeals before the Ninth Circuit.
Plantronics Inc. v. BlueAnt Wireless Pty., Ltd. Lead counsel for the defendant in patent infringement litigation in the Northern District of California. The case was successfully settled.
In the Matter of Certain Wireless Headsets (ITC). Lead counsel for a foreign manufacturer of Bluetooth headsets accused of patent infringement before the International Trade Commission. The case settled after the Administrative Law Judge ruled at summary judgment that the patent claims were invalid.
Kundra v. Lee. Lead counsel for an individual plaintiff in a dispute involving claims of trade secret misappropriation, breach of fiduciary duty, breach of contract, and fraud. Patricia obtained a favorable settlement for her client.
Vieste, LLC v. Hill Redwood Development Ltd. Lead counsel for plaintiffs in a breach of contract and fraud action stemming from a failed real estate development project. Patricia prevailed on a Daubert motion to exclude the defendants’ expert, resulting in settlement of the plaintiff’s claims on highly favorable terms.
Light Field Lab, Inc. v. Prudential Overall Supply. Lead counsel for Light Field Lab, Inc. in a commercial dispute involving allegations of breach of contract and fraud by Prudential Overall Supply.
